On August 21, 1996, President Clinton signed into law the Health Insurance Portability and Accountability Act (HIPAA) of 1996 (Public Law 104-191). One part of the law is intended to reduce the costs and administrative burdens of healthcare (Administrative Simplification). Through this law, the Department of Health and Human Services (DHHS) is charged with the development of standards and requirements for maintaining and transmitting health information that identifies individual patients. The standards are designed to: 1) improve the efficiency and effectiveness of the healthcare system by standardizing the transmission of electronic data for specific administrative and financial transactions and 2) protect the security and confidentiality of electronic health information.

HIPAA has been said to be the most sweeping legislation to affect the healthcare industry in over 30 years. Nearly everyone in healthcare (and other organizations that do business with healthcare organizations) will be affected by the law. As it stands today the following types of organizations will be subject to the HIPAA laws: health plans, payers, employers, providers, health care information systems vendors, billing agents, and service organizations. The industry consensus is that the impact of HIPAA will be more extensive than the Year 2000 conversion.

HIPAA Arizona

The HIPAAZ work group membership is comprised of state agencies that are affected by HIPAA. The cooperative work group was created as a communication vehicle where agencies can work together to resolve common HIPAA issues, review overall HIPAA status and coordinate HIPAA activities within the state.

 

State Agencies

In addition to performing all necessary steps to ensure agency HIPAA compliance, members of HIPAAZ are encouraged to share experiences, lessons learned and offer suggestions to sister agencies where appropriate. By providing documents and other HIPAA related tools that were found to be useful in the course of the HIPAA activities, agencies can help each other and reduce time and money spent on redundant tasks.

CMS Releases Final Rules for Security and Transactions

2/13/03 -- HIPAA Security Standards Final Rule Published - The final Rule adopting HIPAA standards for the security of electronic health information will be published in the Federal Register on February 20, 2003. This final rule specifies a series of administrative, technical, and physical security procedures for covered entities to use to assure the confidentiality of electronic protected health information. The standards are delineated into either required or addressable implementation specifications.

2/13/03 -- Modifications to HIPAA Transactions and Code Set Standards Finalized - The Final Rule adopting changes to the HIPAA Electronic Transactions and Code Set Standards will be published in the Federal Register on February 20, 2003. This final rule modifies a number of the electronic transactions and code sets adopted as national standards under HIPAA, and eliminates the NDC code set as the standard for all providers except retail pharmacies. It does not adopt a standard reporting drugs and biologics on non-retail pharmacy transactions.
